Pregnancy Discrimination

Part of the Title VII of the Civil Rights Act is the Pregnancy

Discrimination Act (PDA). The focus of a PDA claim is whether an

employer’s policy treats pregnant workers less favorably than it treats

non-pregnant workers who are similar in their ability or inability to work;

or whether an employer subjects a pregnant worker to a materially

adverse employment action, including a hostile work environment,

because of pregnancy. Most state laws are similar.

Evidence File

This week we are discussing the attached Simulation – Case Study,

according to current U.S. discrimination laws. This Case Study is a

copy of material from the case file of the terminated employee’s

attorney, who is preparing to sue the employer. In your initial main post

develop the following:

1. The Simulation presents evidence in meeting notes,
conversations, and emails. Do you find evidence of pregnancy
discrimination in employment? For example, for evidence: what

can you anticipate will be testimony in the case? Who would you
depose? What will be written evidence?

2. Analyze the employer’s conduct throughout the time period
represented in the Simulation. Based on this Simulation
recommend one (1) take-away lesson you would advise
businesses for managing employment of pregnant workers.

3. Note: Support your ideas with your learning materials and any
research you wish to include. Remember, APA citations are not
required.
