Case Study

The Toxic Waste Collateral Dilemma

A long-time customer approaches you for financing for a new business venture. The customer offers a piece of property as collateral for a planned housing development. An appraiser discovers that the property contains toxic waste that is slowly migrating and may contaminate nearby farmland and water sources in the future.

You inform your manager. Your manager instructs you to reject the property as collateral but strictly forbids you from informing the customer about the toxic waste. He states: “Let them find out about it themselves.”

You must decide whether to:

Inform the customer about the toxic waste,

Inform government regulators,

Or follow your manager’s instructions.
