The purchase of Twitter (now called X) was one of the most significant contracts in the United States. Elon Musk agreed to purchase Twitter for $44 billion, but during the months leading up to the final purchase, there was much uncertainty about whether the deal would go through. One central legal question arose: Could Musk back out of the agreement once the contract was signed? This situation highlights essential aspects of contract law, including the consequences of breaking a contract and the legal remedies available when one party no longer wants to honor the agreement.
For this discussion, watch the following video that explains the basics of contract law and the options available when one party wants to exit a contract but the other party still wants to move forward: Elon Musk, Twitter, & Contract Law: Could He Have Bailed?
After watching the video, write 200–250 words reflecting on the following:
- What are the key components of a contract, and how do they apply to Elon Musk’s agreement with Twitter? Consider the contract’s elements, such as offer, acceptance, consideration, and breach or remedies.
- What do you think could happen if contracts were not legally enforceable, especially in big business deals such as the one between Elon Musk and Twitter? Feel free to share whether you believe Musk should have been allowed to back out of the agreement and why.
